You are right, but I think in this case this doesn't really apply. Someone else called the police and they didn't have a choice but to come. They recognized the cache for what it is and nobody gets charged for anything - not the cache owner and not that unlucky finder.
The only one to blame in this case I think is the muggle who had to report this 'suspicious' behavior. It would have been much easier to simply ask, or if that would have been too scary, to go back to the tree and look for what he hid there. Don't get me wrong, I am all for watchful neighbors, but there also has to be some common sense.
